Ordinance N° 305/99 (HAVEN)
CONSIDERED:
the Articles 17 & 81 of the Naval Code, approved with R.D. n. 327 dated
30.03.1942;
CONSIDERED: the Article 59 of the Appliance Regulation for the Navigation Code
(maritimal section) approved with D.P.R. n.328 dated 15.02.1952;
CONSIDERED: the Act 14.07.1965, n. 963 about the rules for Sea Fishing and the
Norms to its appliance, approved with DPR n° 1639 dated 2.10.1968:
CONSIDERED: its own ordinance n.197/93 dated September 18th 1993 that,
due to judicial needs, has forbidden the fishing and the anchoring within the
sea area having a ray of 670 ft/200 m. and its center placed at the point at
which the main wreck part of the motortanker HAVEN sunk;
CONSIDERED: the note dated September 8th 1999, on which base the 2nd Penal Section
of the Court of Appeal of Genova, involved by this Coast Guard with communication
n. 35769/Tec. dated September 01st 1999, has informed that there are not further
trial needs for the maintenance of such ordinance;
IN CONSIDERATION OF THE NEED of regulating, for safety grounds, possible
scuba diving activities at the wreck at stake, when considering the structural
characteristics of this same wreck;

its own ordinances n.126/92 dated January 16th 1992 and following amendments
and the n.18/99
dated February 16th 1999:

The scuba diving activities at the point where the main wreck part of the motortanker
"HAVEN" is lying, and more precisely within the area range having
a ray of 670 ft/200 m. and center at the point with following coordinates: LAT
44°22'.3 N and LON 08°42'.1 E, must be performed in compliance with
following perscriptions:
-
thorough compliance with the safety regulations as stated in
the ordinance n.18/99
dated Febrary 16th 1999, like in the mentioned foreword;
- exclusively with scuba dives under guide accompaniment
and naval units support;
- in amendment of art. A-4 of the ordinance n.18/99,
with accompaniment of not more than three divers
at a time;
- with activity of guided scuba dives which are reserved to enterprises ans
associations that expressively foresee such activities within their Regulations
Act or Statute.
